Terms and conditions for the HoneyZooms Competition 1 ("Prize Draw 1")

By entering the Prize Draw 1, you agree to be bound by these terms and conditions (these "Terms and Conditions"). Promotional materials relating to the Prize Draw 1, including all information on how to enter the Prize Draw 1, also form part of these Terms and Conditions. In the event of any conflict between any terms referred to in such promotional materials and these Terms and Conditions, these Terms and Conditions take precedence.

1. The promoter of this Prize Draw 1 is Hotels.com, L.P. ("Hotels.com").

2. Participants must be at least 18 years old, legally resident within the United Kingdom and have an Instagram account. Employees and agents of Hotels.com or any of its subsidiary or affiliated companies and their immediate families and members of their households, and anyone otherwise connected with operation or fulfilment of the Prize Draw 1 are not eligible to take part. Hotels.com reserves the right to require participants to prove that they are eligible to enter the Prize Draw 1. If the winner is found to be ineligible, Hotels.com reserves the right to award the prize to another participant and to require the return of any prize already awarded.

3. The Prize Draw 1 commences at 00.01 BST on 13th May 2020 and all entries must be received by 23.59 BST on the closing date of 21st May 2020.

4. Entry to the Prize Draw 1 is free; no purchase is necessary.

5. Prize Draw 1To enter the Prize Draw 1 you must follow the Hotels.com Instagram account, @hotelsdotcom (https://www.instagram.com/hotelsdotcom) and upload an image of your or your friend’s remote wedding celebration whose wedding was cancelled due to COVID-19 and tagging @hotelsdotcom using the hashtag #honeyzooms. You must have your friend’s permission to post the image. Your Instagram profile must be public in order to enter. Entries submitted by any other means will not be accepted: only those submitted via the official methods of entry. Use of script, macro or any automated system to enter the Prize Draw 1 is prohibited and entries made (or which appear to have been made) using any such system may be treated as void. Any illegible, incomplete or fraudulent entries will be rejected. Participants may enter the Prize Draw 1 as many times as they like, however participants may only win one prize per person, irrespective of the number of entries submitted.  

6. There are two prizes to be won which each consist of a £1,000 Hotels.com gift card which can be redeemed against an eligible booking on the UK version of the Hotels.com website by the winner (if the winner is pictured in the winning entry) or one of the couple pictured in the winning entry (Winning Couple) . The winner and/or Winning Couple are responsible for paying all associated costs that are not specifically stated in these Terms and Conditions and are personally responsible for any personal or incidental expenses and any VAT, national and/or local tax liabilities incurred in claiming or using the prize. Use of the prize is subject to the Gift Card T&Cs in the Annex to these Terms and Conditions. The prize is as stated and is non-exchangeable and non-transferable. There is no cash or other alternative to the prize in whole or in part. By participating in the Prize Draw 1, participants agree that the prize is awarded on an "as is" basis, and that neither Hotels.com nor any of its subsidiary or affiliated companies, make any representations or warranties of any nature with respect to the prize.  

  1. The winners of the Prize Draw 1 will be the first two names chosen at random from all complete, eligible, properly submitted entries received before the end of the applicable closing date.
  2. The winners will be notified no later than 24 hours after the closing date by Instagram Direct Message via the Hotels.com Instagram account (@hotelsdotcom). The winner (if not part of the Winning Couple) will be required to communicate the win to the Winning Couple and to ask the Winning Couple to contact Hotels.com to claim the prize by providing their name and email address. The full details of the prize will be emailed to the winner or the Winning Couple, as applicable. The winner or Winning Couple may be required to submit valid identification before receiving their prize. If social media messages to the winners are returned as undeliverable or the Winning Couple has not contacted Hotels.com within 48 hours after the closing date Hotels.com reserves the right to conduct a further random draw to award their prize to another participant. If the winner has not claimed their prize within 7 days of being notified, Hotels.com reserves the right to conduct a further random draw to award the prize to another participant.
  3. In the event that, for reasons beyond Hotels.com's reasonable control and not related to the winner, Hotels.com is unable to award the prize as described in these Terms and Conditions, Hotels.com reserves the right to award a prize of a similar nature and an equivalent value, or at its sole discretion, the cash value of the prize. In the event of a printing or other error resulting in there being more winners than prizes for the Prize Draw 1, Hotels.com reserves the right at any time to allocate the available prize through a further draw or to divide the prize or the value of the prize between the winners of the Prize Draw 1.
    1. By entering the Prize Draw 1, participants agree to have their name and photograph featured in publicity materials relating to the Prize Draw 1 without further reference, payment or other compensation.  Details of the winner will also be made available to participants and the public on request by sending a letter and stamped addressed envelope to Brand Comms, Hotels.com, 407 St John St, London EC1V4EX no later than 1st June 2020.
  4. Although the Prize Draw 1 may be featured on Instagram, the Prize Draw 1 is in no way sponsored, endorsed, administered by, or associated with Instagram and you agree that Instagram are not liable in any way. You are providing information to Hotels.com and not to Instagram. The information you provide will only be used for the purposes referred to in clause 12 below.
    1. Hotels.com will collect and process participants' personal information in order to conduct the Prize Draw 1 and it will be shared with Hotels.com's agents to the extent necessary for the prize to be delivered to the winner and/or Winning Couple. If participants do not provide any of the mandatory information requested when entering and taking part in the Prize Draw 1, they may not take part in the Prize Draw 1. Participants' names and other personal details from their entry to the Prize Draw 1 will be collected and stored by Hotels.com and held in accordance with the applicable privacy policy in place from time to time (for UK participants, see https://uk.hotels.com/hotel-deals/privacy/)
  5. Hotels.com reserves the right to reasonably modify, cancel, terminate or suspend the Prize Draw 1 in whole or in part, at its sole discretion, if it believes the Prize Draw 1 is not capable of being conducted as specified within these Terms and Conditions or in the event of a virus, a computer bug or unauthorized human intervention or any other cause that is beyond the reasonable control of Hotels.com that could corrupt or affect the administration, security, impartiality or normal course of the Prize Draw 1. Neither Hotels.com nor any of its subsidiary or affiliated companies are responsible for any condition, circumstances, losses, failures or delays caused by events beyond its or their control such as (but not limited to) the acts or defaults of any supplier selected by Hotels.com to provide the prize or otherwise that may cause the Prize Draw 1 to be disrupted or corrupted, or that may lead to loss or damage of the prize in transit to the winner.
  6. Save where it has been negligent, Hotels.com will not be responsible for any damage, loss or injury resulting from participants' entry into the Prize Draw 1 or their acceptance and/or use of the prize, or for technical, hardware or software failures, lost, faulty or unavailable network connections or difficulties of any kind that may limit or prohibit their ability to participate in the Prize Draw 1. Hotels.com will not be responsible for any lost, damaged, defaced, incomplete, illegible or otherwise unreadable entries. Proof of posting is not proof of receipt by Hotels.com of any entries. Nothing in these Terms and Conditions shall in any way limit Hotels.com's liability for death or personal injury caused by its negligence or for any other matter where liability may not as a matter of law be limited.
  7. Any participant who enters or attempts to enter the Prize Draw 1 in a manner, which in Hotels.com's reasonable determination is contrary to these Terms and Conditions or by its nature is unjust to other entrants (including without limitation tampering with the operation of the Prize Draw 1, cheating, hacking, deception or any other unfair playing practices such as intending to annoy, abuse, threaten or harass any other entrants or Hotels.com and/or any of its agents or representatives) may be rejected from the Prize Draw 1 at Hotels.com’s sole discretion. Furthermore, where such actions have significantly impaired the Prize Draw 1, Hotels.com may reasonably add further stages to the Prize Draw 1 as it deems reasonably necessary in order to resolve any problems arising as a result of such actions.
  8. All Hotels.com's decisions in relation to the Prize Draw 1 are final and Hotels.com will not enter into any correspondence with participants.
  9. These Terms and Conditions are governed by English law. The courts of England and Wales shall have exclusive jurisdiction to hear any dispute or claim arising in association with the Prize Draw 1 or these Terms and Conditions.

 

Annex – Gift Card T&Cs

Gift card terms and conditions

 

You can use your GBP e-Gift Card(s) on the UK version of Hotels.com. Cards may not be redeemed for cash. Cards will not be replaced if lost or stolen. Treat this card like cash.

You must redeem your gift card on hotels.com at the time of booking. Bookings are subject to availability and the hotel's terms and conditions.

This e-Gift Card can't be used for:

  • Bookings paid for at the hotel
  • Bookings made over the phone
  • Package bookings i.e. hotel + flight
  • Bookings made through the tab entitled Groups & Meetings
  • Bookings made prior to receipt of this e-Gift Card

Card will expire 3 years after the date it was purchased. Card is distributed by Hotels.com at 5400 LBJ Freeway, Suite 500, Dallas, Texas 75240, USA. However, Hotels.com is not an obligor to card owner and is not affiliated with CARDCO. CARDCO CXXXIX, Inc. is the card issuer and sole obligor to card owner. CARDCO may delegate its issuer obligations to an assignee, without recourse. If delegated, the assignee, and not CARDCO, will be sole obligor to card owner. By entering the Prize Draw 2, you agree to be bound by these terms and conditions (these "Terms and Conditions"). Promotional materials relating to the Prize Draw 2, including all information on how to enter the Prize Draw 2, also form part of these Terms and Conditions. In the event of any conflict between any terms referred to in such promotional materials and these Terms and Conditions, these Terms and Conditions take precedence.

Entries submitted by any other means will not be accepted: only those submitted via the official methods of entry. Use of script, macro or any automated system to enter the Prize Draw 2 is prohibited and entries made (or which appear to have been made) using any such system may be treated as void. Participants may nominate as many people as they like who have had their wedding cancelled due to COVID-19 and has had a remote wedding celebration instead, however participants may only win one prize per person, irrespective of the number of entries submitted.
