Terms and Conditions for the Hotels.com “Travels with my Mother” Giveaway (the "Prize Draw")

By entering the Prize Draw, you agree to be bound by these terms and conditions (these "Terms and Conditions").
The information you provide will only be used for the administration of this Prize Draw and in accordance with Hotels.com’s privacy policy (see below).
1. The promoter of this Prize Draw is Hotels.com, L.P., a Texas limited partnership having its registered office at 5400 LBJ Freeway, Suite 500, Dallas, TX 75240, USA ("Hotels.com").

2. Participants must be at least 18 years old and have reached the age of majority in their jurisdiction of residence and legally resident within the United Kingdom. Employees and agents of Hotels.com or any of its subsidiary or affiliated companies and their immediate families and members of their households, and anyone otherwise connected with operation or fulfilment of the Prize Draw are not eligible to take part. Hotels.com reserves the right to require participants to prove that they are eligible to enter the Prize Draw. If the winner is found to be ineligible, Hotels.com reserves the right to award the prize to another participant and to require the return of any prize already awarded.

3. The Prize Draw commences at 00:01AM on 16th March 2022 (BST) and all entries must be received by 23:59PM on the closing date of 31st March 2022 (BST).

4. To enter the Prize Draw, participants must either be a Hotels.com member or sign up to be a Hotels.com member before entering. They must then submit their funniest travel story or memory with their mum/mum-like figure, in less than 100 words, on the dedicated webpage <https://uk.hotels.com/page/travelswithmum/?pos=HCOM_UK&locale=en_GB>. Participants must also include their entry, full name, email address, contact number to be entered into the Prize Draw. Entries submitted by any other means will not be accepted: only those submitted via the official method of entry will be accepted and entered into the Prize Draw.

5. The Prize Draw will be promoted on the website at the following URL address: <https://uk.hotels.com/page/travelswithmum/?pos=HCOM_UK&locale=en_GB> (the "Website"). Use of script, macro or any automated system to enter the Prize Draw is prohibited and entries made (or which appear to have been made) using any such system may be treated as void. Any illegible, incomplete or fraudulent entries will be rejected.

6. There is one (1) prize across all entries to be won. The prize consists of 10 Hotels.com gift cards (“Prize”) worth £300 each and the winner will be upgraded to Gold status on the Hotels.com rewards program. One (1) winner will be selected at random to win the Prize. The Prize has a total approximate retail value (“ARV”) of £3,000. If the winner is already a Gold member, they will receive one extra night worth £300.

7. Any difference between stated ARV and actual value will not be awarded. The Prize may only be redeemed by a winner and a winner may be required to present personal identification to prove their identity. A winner is responsible for paying any applicable income and withholding taxes, if any, and any and all other costs and expenses not listed herein as being provided. In the event that any tax withholding is required by law for the Prize (or a portion thereof), winner authorises Hotels.com to make the to make the corresponding deduction from the prize amount. The prize is as stated and is non-exchangeable and non-transferable. Hotels.com will not replace any lost or stolen prizes or prize components. A winner may not transfer, assign or substitute a Prize, or redeem a Prize for cash, except at the sole discretion of Hotels.com, who reserves the right to substitute a Prize (or portion thereof) with one of comparable or greater value. By participating in the Prize Draw, participants agree that the Prize is awarded on an “as is” basis, and that neither Hotels.com nor any of its subsidiary or affiliated companies makes any warranties of any nature other than statutory warranties and other than given in the present Terms and Conditions with respect to the Prize. The winner of the Prize Draw will be the first name chosen at random from all complete, eligible, properly submitted entries received from among all participating countries before the end of the applicable closing date.

8. The winner will be notified no later than 60 business days after the competition end date via the email address provided on entry to the Prize Draw. The winner may be required to submit valid identification before receiving their prize. The prize will be automatically deposited into the winner’s Rewards account within 90 of days after winner is confirmed. If any e-mail(s) to the winner are returned as undeliverable or a winner does not claim the prize within 72 hours, Hotels.com reserves the right to conduct a further random draw to award their prize to another participant.

9. In the event that, for force majeure reasons Hotels.com is unable to award a prize as described in these Terms and Conditions, Hotels.com reserves the right to award a prize of a similar nature and an equivalent value, or at its sole discretion, the cash value of the prize.

10. By entering the Prize Draw and agreeing to its terms, participants, including the persons who are nominated, agree to have their name and photograph featured in publicity materials, on all available media, including the Internet (on all Hotels.com related websites, webpages, online accounts, web-banners, emailing etc.) and in any kind of materials (printed materials, posters, press, POS advertisings, etc.) for promotional purposes relating to the Prize Draw, worldwide and for a period of one (1) year starting from the date of their participation, without further reference, payment or other compensation.

11. Hotels.com may collect and process your personal information directly or through our agents or contractors. We will use your personal information as necessary in order to conduct and manage “The Travels with my mother” Giveaway, and, where we have a lawful basis to do so, to send marketing communications to you. We may disclose your personal information to our related companies, agents, and contractors to assist in conducting and managing this offer, communicating with you, or storing data. This may include disclosures to organizations outside of United Kingdom.

The participants’ personal data is stored for the duration of the Prize Draw, for duration necessary for the delivery of the prizes.
Any participant has the right to access his or her personal data, to request from the data controller rectification or erasure of his or her personal data or restriction of processing concerning his or her data or to object to processing, as well as the right to data portability. Participants also have the right to provide guidance regarding the management of their personal data after their death. 12. Hotels.com reserves the right to modify, cancel, terminate or suspend the Prize Draw in whole or in part, in an event of force majeure such as a virus, a computer bug or unauthorized human intervention or any other cause that could corrupt or affect the administration, security, impartiality or normal course of the Prize Draw provided it meets the conditions of force majeure. Neither Hotels.com nor any of its subsidiary or affiliated companies are responsible for any condition, circumstances, losses, failures or delays caused by force majeure events as defined by UK law.

13. Except in the event that Hotels.com has breached its legal or contractual obligations, Hotels.com will not be responsible for any damage, loss or injury resulting from participants' entry into the Prize Draw or their acceptance and/or use of the prize, or for technical, hardware or software failures, lost, faulty or unavailable network connections or difficulties of any kind that may limit or prohibit their ability to participate in the Prize Draw. Hotels.com will not be responsible for any lost, damaged, defaced, incomplete, illegible or otherwise unreadable entries. Nothing in these Terms and Conditions shall in any way limit Hotels.com’s liability for death or personal injury caused or for any damage caused by breach of its contractual obligations or for any other matter where liability may not as a matter of law be limited.

14. Any participant who enters or attempts to enter the Prize Draw in a manner, which is contrary to these Terms and Conditions or by its nature is unjust to other entrants (including without limitation tampering with the operation of the Prize Draw, cheating, hacking, deception or any other unfair playing practices such as intending to annoy, abuse, threaten or harass any other entrants or Hotels.com and/or any of its agents or representatives) may be rejected from the Prize Draw. Furthermore, where such actions have significantly impaired the Prize Draw, Hotels.com may add further stages to the Prize Draw as it deems reasonably necessary in order to resolve any problems arising as a result of such actions.

15. All Hotels.com's decisions in relation to the Prize Draw are final and Hotels.com will not enter into any correspondence with participants.

16. These Terms and Conditions are governed by English law. The courts of England and Wales shall have exclusive jurisdiction to hear any dispute or claim arising in association with the Prize Draw or these Terms and Conditions.
